Hot Topic – Leave as an Accommodation After FMLA Leave Expires

Many employers are having a hard time getting their arms around how much leave an employee, who is disabled under the ADAAA, is entitled to when the employee's FMLA leave expires. How long can the employee stay out under ADAAA leave? Can an employer deny the leave? What is "undue hardship?" What are the best practices in dealing with an employee who requests this type of leave? Can an employer replace the employee? Is the employee entitled to his/her position upon return to work at the end of the leave? These and many other issues will be addressed at during this presentation.
About the Speaker
Robert Williams has counseled and defended companies across the nation on employment matters for more than 18 years. He is senior counsel in Baker Donelson's Memphis office, and has litigated matters in federal and state courts in more than 35 states. He has successfully tried more than 60 jury trials to conclusion and counsels clients in a wide variety of industries, including hospitality, restaurant, pharmaceutical, health care, retail, manufacturing, trucking and others.
Mr. Williams defends and advises clients on all manner of employment matters, including wage and hour, hiring and termination, reductions in force (WARN Act), harassment, personnel and supervisory policies, arbitration, mediation, employee privacy and more. He recently defended a client against the EEOC, and not only won a dismissal of the case, but the client was awarded substantial attorneys' fees against the government. He is a frequent lecturer on employment law, speaking at seminars, briefings and events sponsored by the Society for Human Resource Management, and other groups.
In addition to his labor and employment work, Mr. Williams has successfully handled defense of personal injury, products liability, Federal Employees Liability Act, medical malpractice and other general litigation cases. Prior to entering private practice, Mr. Williams served as Executive Assistant U.S. Attorney and Chief of the Civil Division in the U.S. Attorney's Office, Western District of Tennessee.
Representative Matters
? Defended client against EEOC charges of disparate impact discrimination. Secured dismissal of the case and client was awarded more than $750,000 in attorneys' fees from the EEOC.
? Successfully defended client sued by EEOC for sex discrimination in Houston, Texas.
? Successfully defended client sued by former employee in complicated Family and Medical Leave Act case.
? Defended multiple clients charged with violations of the Fair Labor Standards Act, including defense of collective actions and Department of Labor audits.
? Defended client in successful class action litigation under WARN Act in bankruptcy court in Ohio.
? Successfully defended dozens of suits against various clients in the restaurant and transportation industries nationwide.
? Advised client on successor and WARN Act liability concerning asset purchase sale of company.
